Supporting Documentation for Employees of Registered Companies
E-visa company registration indicates that a Consular Officer has previously determined that the company met E-visa standards on a prior application. During the registration period, if the treaty enterprise seeks to send additional employees to the U.S. on an E-visa, those employees may apply through the process detailed below. Unless there have been substantive changes to the enterprise that would jeopardize its E-visa status, subsequent applications can focus on whether and how a given employee qualifies for an E-visa as the owner, manager or essential employee of a registered E-visa company. However, if there have been substantial changes in the company’s ownership structure or operations since the registration notice was issued, the Consular Officer may require additional corporate documents to ensure the treaty enterprise still qualifies.
If the company's registration is set to expire soon, the next applicant from the company should follow the instructions for new cases and renewals to seek re-registration for the company. The Consulate in Toronto will only register a company in the context of a visa application.
Required Documentation
Applicants from currently registered companies are no longer required to submit supporting documents by mail to the Consulate in advance of the scheduled visa interview. If you are applying as an employee from a treaty enterprise with a valid company registration from the Consulate in Toronto or Vancouver, you should bring the following documents to the visa interview:
- Confirmation of appointment.
- Copy of the Notice of E-Visa Company Registration, issued by the Consulate in Toronto or Vancouver.
- DS-160 confirmation page for all applicants and dependents.
- Updated DS-156E (587KB PDF) signed by an officer legally empowered to act in the company's name.
- One 2x2 passport-style photograph for each applicant, taken on plain white background within the last six months (if your photograph could not be uploaded to your online DS-160).
- Letter from the company providing specific information on the applicant and the reasons for his/her assignment to the U.S. The letter must explain the employee's role in the E-visa company (job title and duties), the applicant's executive or supervisory responsibilities or, if not a supervisor, his/her specialist role, the level of education and knowledge required by the employee's position, his/her employment experience, progression of promotion or high level training or special qualifications and the reasons why a U.S. citizen or legal permanent resident cannot fill the position (if the position is not managerial or supervisory).
- Supporting evidence as to the individual's qualifications as an Investor, Managerial/Executive, or Specialized/Essential employee.
- A signed statement from the owner, CEO, corporate secretary, or executive attesting to the fact that there have been no substantial changes in the ownership structure or operations of the treaty enterprise that would jeopardize its E-visa qualifications since the company was registered. If there have been substantive changes to the company, please explain the changes and provide appropriate supporting documentation.
- Dependents – proof of legal relationship between the principal applicant and any dependents (spouse or child under age 21), e.g. original government issued birth and/or marriage certificates, adoption papers, etc. Notarized copies, religious documents, hospital records, and short form birth certificates that do not show parentage do not satisfy this requirement.
- Appropriate reciprocity fee, if required.
